1. Introduction

Welcome to DDaily ("DDaily", "we", "us"). These Terms of Service ("Terms") govern your access to and use of the DDaily application, website and related services (the "Service"). By creating an account or using the Service you agree to these Terms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use DDaily. By using the Service you confirm that you meet these requirements.

3. Account Registration

You are responsible for the accuracy of the information you provide and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

4. Description of Service

DDaily is a personal decision support tool. It provides an AI-generated "Board of Advisors" that analyzes the situations you describe, along with goal tracking, decision history, memories and outcome tracking.

5. AI-Generated Decision Support

Reports generated by the Service are produced by automated systems based on the information you provide and your saved context. AI output can be incomplete, inaccurate or biased. You are responsible for evaluating it before acting on it.

6. No Professional Advice

DDaily does not provide financial, legal, medical, mental-health, tax, investment or other professional advice. Nothing on the Service constitutes such advice. Consult a qualified professional before making decisions that require it.

7. User Responsibility

You alone are responsible for the decisions you make. DDaily is a thinking tool, not a substitute for your own judgment.

8. Subscriptions and Billing

DDaily offers a Free plan and a Pro plan billed at $10 per month. Paid subscriptions are processed by Paddle, our payment provider and merchant of record. By subscribing you authorize Paddle to charge your payment method on a recurring basis until you cancel.

9. Free Plan and Usage Limits

The Free plan includes a monthly allowance of AI Board reports. Once the allowance is reached you can continue to view your existing reports, apply a code, or upgrade to Pro. Pro is presented as unlimited and subject to a fair-use threshold to prevent abuse.

10. Promo Codes

We may issue promo codes for beta users, founders or marketing campaigns. Codes are subject to redemption limits, expiry dates and any conditions stated when the code is issued. Promo access has no cash value and can be revoked in cases of abuse.

11. Acceptable Use

You agree to use DDaily in good faith and in compliance with applicable law.

12. Prohibited Use

You may not (a) reverse engineer or interfere with the Service, (b) use the Service to harass or harm others, (c) submit unlawful content, (d) attempt to bypass usage limits or security controls, or (e) use the Service to generate content that violates the rights of others.

13. Intellectual Property

The Service, including its software, branding and design, is owned by DDaily or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

14. User Content and Data

You retain ownership of the content and information you submit. You grant DDaily a limited license to process this content solely to operate and improve the Service for you. See our Privacy Policy for details.

15. Service Availability

We strive for high availability but the Service is provided on an "as is" and "as available" basis. We may modify, suspend or discontinue features at any time.

16. Disclaimers

To the maximum extent permitted by law, DDaily disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, DDaily will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill arising out of your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

18. Termination

You can stop using DDaily at any time. We may suspend or terminate your account if you breach these Terms or abuse the Service.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
